Dell Can Make Transgender Engineer Arbitrate Sex Bias Claims

A transgender woman must mostly arbitrate her sex discrimination and retaliation claims against Dell Technologies Inc. over her alleged firing by a subsidiary, the Southern District of New York ruled.

The technology giant can enforce the arbitration agreement Cicilia Gilbert accepted upon her promotion to “Director, Systems Engineer” at Virtustream Inc. in 2016 even though Dell didn’t sign the relevant documents, the court said Nov. 11. Her acceptance required her to arbitrate employment disputes including discrimination claims with Virtustream and EMC Corp.; EMC acquired Virtustream in 2015, and Dell purchased EMC in 2016, the court said.
