Tesla Vs Tesla? Elon Musk’s EV Giant Sues Indian Battery Maker Over Trademark Rights In Delhi High Court

While we await Tesla India to arrive in the country, the EV giant led by Elon Musk is keen on stifling competition, including any bizarro version of the brand emulating even its logo or the name itself. But isn’t that too much, you may ask. It’s like opening a bottling plant named Coca Cola. It’s not allowed. The American EV company has filed a lawsuit against the Indian company Tesla Power India Ltd in the Delhi High Court, for promoting its products under the brand name ‘Tesla Powers.’ The Indian company had received a cease-and-desist order way back in April 2022, however, there was neither a cease nor a desist by the Gurgaon based company. The company started showcasing EV products under a similar sounding brand name as Tesla.

Musk’s company has been communicating with the Indian firm as early as 2020 about the trademark. The Indian Tesla company’s chairman, Kavinder Khrurana, stated during the latest hearing that the company has a partner and promoter in the US as well. Tesla’s counsel, Chander Lall, contended that this is creating quite a bit of confusion among the customers, thereby harming business interests. The Delhi HC has issued a notice to Tesla Power in response to Tesla Inc.’s plea. The HC has also restrained the Indian company from publishing or promoting further advertisements of its EV products under the same brand name. The next hearing on the issue is on May 22. Meanwhile, the Indian company maintained the argument that they are primarily a lead acid battery manufacturing firm and not into any EV deliverables.
